The Promotion is void outside the United States and where prohibited by law. Entrant must use an official fishing rod sold by Sponsor or one of its authorized retailers (\u201cOfficial Rod\u201d) and catch one (1) of the \u201cEligible Species\u201d from the list below that qualifies as a State Record by weight. The Eligible Species list below is subdivided by one of four \u201cRod Series\u201d that reflect the Official Rod that an Entrant must use to catch a particular Eligible Species (for example, you may catch a Flathead Catfish with the Big Cat Fever Rod, but not a Striper Stealth Rod). The first Entrant during the Promotion Period to complete the foregoing and who fully complies with these Official Rules (including all winner verification requirements) will be eligible to receive the Rod Category Prize (defined below).<\/p><\/div><\/div>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

          5. How To Participate<\/h3>

          If you have a good faith belief that you have caught a State Record from an Eligible Species list under one of the Promotion Categories above, you must promptly (but in no event later than 48 hours) notify Sponsor through a preliminary notice via certified mail indicating your belief and intent to submit an Entry (\u201cInitial Notice\u201d). The Initial Notice must indicate what Promotion Category you will submit an Entry under, the Eligible Species, and (specifically for the Rod Category) the Rod Series. You must keep and retain a copy of the Initial Notice for your records and for submission of an Entry (below). Following submission of your Initial Notice, you must promptly (but in no event later than thirty (30) days, except as authorized by Sponsor in writing) secure an individual state record certification via application through your individual state Department of Natural Resources; Fish and Game Division; Parks and Wildlife Agency or other similar government agency responsible for certifying state record fish (\u201cAuthority\u201d). Once your Eligible Species catch has been certified in writing by an Authority as the new state record fish by weight(a \u201cState Record\u201d) you must promptly (but in no event later than ten (10) days from the time of State Record certification) notify Sponsor via mail including the following (all of which, once submitted, shall be your \u201cEntry\u201d):\n

            \n \t
          • A copy of the Initial Notice;<\/li>\n \t
          • A copy of the State Record certification;<\/li>\n \t
          • One or more photo(s) that show the following in a clearly visible format you wearing Official Apparel and\/or using an Official Rod in plain view (each must be clear and distinguishable in the photo) while simultaneously (within the same photo) holding, cradling, netting, or otherwise demonstrating your possession of the State Record;<\/li>\n \t
          • If you are submitting for the Rod Category, your State Record must have been caught using an Official Rod and you must attest to that in your Entry.<\/li>\n<\/ul>\nOnce an Entry is received by Sponsor, Sponsor will evaluate the contents of the Entry, in totality and with relation to these Official Rules, and make a decision in its sole discretion as to whether the Entry meets the requirements to receive a Prize.<\/p><\/div><\/div>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

            6. Exclusions and Conditions<\/h3>

            No Prize will be awarded to any Entrant presenting a State Record that has been caught other than during the Promotion Period. To be eligible for a new State Record, a State Record for the Eligible Species must currently exist and the official State Record keeping authority for the corresponding state must have been maintaining record status for the Eligible Species for a minimum period of three (3) years prior to the submission of any new State Record qualifier. No \u201cvacant\u201d or \u201cblank\u201d records are eligible for the Prize. All fish must be caught in \u201cEligible Waters\u201d. Eligible Waters for State Record consideration shall consist of waters of the fifty (50) United States, including territorial waters of each, where the species are indigenous and in which the general public have absolute free and unlimited access. The Gulf of Mexico is included, subject to individual states\u2019 territorial waters and their respective designated boundaries. Fish caught in or from private waters, illegal \u201coff limit\u201d waters, hatchery or hatchery aquaculture facilities, private \u201cpay to fish\u201d waters or \u201cwaters of sanctuaries\u201d are not eligible for the Promotion. You must observe all state and local rules and regulations regarding catch and release. Further, you must observe all industry guidelines and ethics regarding catch and release. If you catch a fish from the Eligible Species list with an Official Rod, you must check whether the Eligible Species and the corresponding Rod Category require the fish to be released alive.\n<\/p><\/div><\/div>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

            7. Entry Submission Guidelines<\/h3>

            \nIf the Entry does not contain all necessary information as described in these Official Rules, the Entry will not be counted. Please be certain to follow all directions provided in these Official Rules. All winning Entrants must execute an Affidavit of Eligibility and Liability Release prior to receiving their Prize. If an Entrant fails or refuses to sign and return such affidavit, or any and all other contract and tax documents within ten (10) days of notification of winner status, such Entrant may be disqualified from the Promotion. The Promotion Entities assume no responsibility for any damage to an Entrant or any other person\u2019s computer system which is occasioned by accessing the Site hosting these Official Rules or otherwise participating in the Promotion. Without limiting the generality of the foregoing, Sponsor is not responsible for incomplete, illegible, misdirected, misprinted, late, lost, damaged, stolen, or incorrect postage on the Initial Notice or any Entry or other Promotion notifications; or for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet Service Providers, websites, or other connections; or for miscommunications, failed, jumbled scrambled, delayed or misdirected computer, telephone or cable transmissions; or for any technical malfunctions, failures, or difficulties, printing errors, clerical, typographical or other error in the offering or announcement of the Promotion or in any Promotion notification documents, or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information. If, for any reason, the Promotion is not capable of running as planned due to causes beyond the control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, Sponsor reserves the right in its sole discretion to cancel, terminate, modify, suspend or extend the Promotion. Any attempt by an Entrant or any other individual to deliberately damage or undermine the legitimate operation of the Promotion, or to annoy, abuse, threaten or harass any other person in connection with the Promotion, is in violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to disqualify the applicable individual and seek damages and other remedies from any such person to the fullest extent permitted by law. Any attempt by any Entrant to enter the same Entry more than one time per Promotion Period by using any method will disqualify the Entrant. Sponsor reserves the right to reject any Entries that do not comply with these Official Rules. An Entry must not be under any restriction, contractual or otherwise, that will prevent Sponsor\u2019s use, as described herein, of the Entry. Entrant acknowledges, agrees and warrants that, nothing in the Entry infringes on any copyrights, confidential information, trade secrets, trademarks or any other intellectual property rights belonging to any other Entrant or entity, or violates any Entrant\u2019s rights of privacy or publicity, and that all necessary releases and permissions have been secured. By submitting an Entry in connection with the Promotion, an Entrant hereby agrees that Sponsor may contact him or her via private message, email or phone regarding his or her submission. Sponsor reserves the right, in connection with any Entry received and verification of compliance with these Official Rules, to require an Entrant to complete a polygraph examination to the satisfaction of Sponsor. Entrant may be required to sign a normal and customary waiver as required by the polygraph examiner and must present the conclusive results of the polygraph examination to Sponsor no later than thirty (30) days after the examination.\n\nFailure of any Entrant to comply with the above \u201cEntry Submission Guidelines\u201d and \u201cEntry Restrictions,\u201d as determined by Sponsor in its sole discretion may result in disqualification of that Entrant. Without limitation, Sponsor reserves the right in its sole discretion to disqualify any Entries that, in Sponsor\u2019s sole discretion, refers, depicts or in any way reflects negatively upon the Sponsor, the Promotion, or any other Entrant or entity, or does not comply with these Official Rules, or if Sponsor receives notification about any potential infringements or breaches of law or any other reason as set forth herein.<\/p><\/div><\/div>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

            8. Sponsor's Use Of Entries<\/h3>

            By submitting any Entry in connection with the Promotion, each Entrant hereby assigns to Sponsor, for zero compensation, all intellectual property and other rights in and to his or her Entry, which rights include, without limitation, the Sponsor\u2019s unrestricted right to use, publish, edit, modify, translate, reproduce, distribute and make available to the public worldwide in all print and electronic media (now or hereafter existing) without time limitation in any manner Sponsor deems appropriate, and the right to include his or her name and likeness in connection with the foregoing uses. Each Entrant agrees and understands that his or her Entry may be made available to the public, including without limitation, on the Internet. Accordingly, Sponsor does not guarantee any confidentiality with respect to any of the Entries. By participating in the Promotion, in addition to any other grants which may be granted in any other agreement entered into between Sponsor and any Entrant in the Promotion, each Entrant hereby irrevocably grants Sponsor and its designees and their respective successors, assigns and licensees, the sole right to use such Entrant\u2019s name, likeness, and biographical information and any media pertaining to the official State Record Fish, in any and all media for any purpose, including without limitation, advertising and promotional purposes, and hereby releases the Promotion Entities from any liability with respect thereto.<\/p><\/div><\/div>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

            9. Prize<\/h3>

            Sponsor will award one (1) prize amounting to $5,000.00 USD to the person that conclusively wins the Apparel Category (the \u201cApparel Category Prize\u201d) and Sponsor will award one (1) prize amounting to $20,000.00 USD to the person that conclusively wins the Rod Category (the \u201cRod Category Prize\u201d). Each of the foregoing is individually and collectively considered the \u201cPrize\u201d for these Official Rules. Sponsor will award only one (1) Prize per Promotion Category. In no event will Sponsor award more than $25,000.00 USD during any Promotion Period. For clarity, the same individual may win both Categories and receive the Prize in both categories. Prize winners, if any, shall be solely responsible for all federal, state or local taxes, and the reporting consequences thereof, and for any other fees and costs associated with the applicable promotional Prize.<\/p><\/div><\/div>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

            • (d) for lost, interrupted or unavailable satellite, network, server, Internet Service Provider, Site or other connections availability, accessibility or traffic congestion, or miscommunications, or failed computer, network, telephone, or cable hardware, software or lines, or technical failure, or jumbled, scrambled, delayed, or misdirected transmissions, or computer hardware or software malfunctions, failures or difficulties;<\/li>\n \t
            • (e) other errors of any kind whether human, mechanical, electronic or network, or the incorrect or inaccurate capture of entry or other information or the failure to capture, or loss of, any such information;<\/li>\n \t
            • (f) any incorrect or inaccurate information, whether caused by Site users, or by any equipment or programming associated with or utilized in the Promotion;<\/li>\n \t
            • (g) any error, omission, interruption, deletion, defect or delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or tampering with or hacking of any Site; or<\/li>\n \t

              By entering, Entrants agree that all issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, Entrant\u2019s rights and obligations, or the rights and obligations of Sponsor in connection with the Promotion, will be governed by, and construed in accordance with, the laws of the State of North Carolina without giving effect to any choice of law or conflict of law rules, and any matters or proceedings shall take place in the State of North Carolina. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds may be tampering with the entry process or operation of the Promotion or any associated Site, may be acting in violation of the terms of an associated Site or these Official Rules or may be acting in a non-sportsmanlike or disruptive manner, or with intent to threaten, abuse or harass any other person. If any provision(s) of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
